What Everyone Should Know About Worker’s Compensation

By John Dir Though many people have heard of worker’s compensation insurance, there are many aspects of this protection that people do not understand. Lack of information can lead to difficult issues when deciding whether or not to choose this path, after work related injury occurs. Understanding your rights and protections under these laws beforehand is important, and will most likely not come in a straightforward explanation from your employer. Worker’s compensation insurance was developed to protect both employers and employees from devastating consequences rising from injuries to workers at their place of employment. The laws related to this form of insurance were written to strike a balance between fair protection to workers for injuries suffered on the job, and protection to employers from paying crippling settlements to employees as a result of people being hurt due to work related causes. As with any laws, the scope of protection is not perfect, and there are many hidden aspects of the procedure which can cause a great deal of concern and grief in getting through the process. The following points will help you to decide what to do when you are injured on the job. 1. Time is important – When you turn to worker’s compensation for help with an injury, it is vital for you understand that time is of the essence. You must decide quickly if you want to file a worker’s compensation claim, and you must be very assertive that this is the path you want to take. You should inform your employer immediately that you are hurt, and tell them the circumstances surrounding the incident. You have a limited amount of time to file a worker’s compensation claim by law, so you need to act within the legal timeframe to qualify for the coverage. A worker’s compensation claim follows a completely different path and procedure than claims covered under your regular health insurance, so the care you seek outside the worker’s compensation channel should be minimal, because any care you receive from your regular doctor will NOT be covered by your health insurance, even if the treatment would normally be covered by that policy. It is also highly possible that the care you receive outside the worker’s compensation system will have to be paid out of pocket by you. When you are hurt, you must decide to file a worker’s compensation claim, or seek treatment from your health insurance provider. Your injuries will be covered and treated by one or the other, but not by BOTH. 2. Worker’s compensation claims are handled by doctors provided by the system, and you will not necessarily have a choice regarding who is in charge of your care, or where you must go to receive your diagnosis and treatment. In some cases, the injured person may feel their worker’s compensation doctor is minimizing care, and understating the extent of personal injury. These perceptions may be well founded, because the system is set up to minimize employer liability and treatment costs. Do not be surprised if a worker’s compensation doctor appears unsympathetic to your pain and suffering. You will have to be more assertive and insistent with these care givers than with those who treat you under your regular insurance coverage. 3. Your supervisor may not understand the procedures established for filing a worker’s compensation claim. If they advise you to seek care from your regular insurance provider, and you are sure that you want to pursue a worker’s compensation claim, do not seek care outside the system based on your supervisor’s recommendation. Regardless of the circumstances or advice, you must be cared for by a worker’s compensation doctor and facility, if the care is to be covered by this claim. 4. Unless you have been through the experience of a worker’s compensation claim, you will not understand how much incorrect advice, misleading direction, and undue intimidation can be associated with trying to pursue this type of action. You will likely receive misinformation from within the system, and you should be prepared to defend your position. Even though employers pay insurance for worker’s compensation claims, the “insurance” company handling these claims will be particularly mercenary in trying to deny you coverage, minimizing your treatment, understating your injuries, and intimidating you into settling for less than you deserve. You should seek legal assistance to help you sort out your rights, clarify your position, and advocate a reasonable settlement for you. Once your claim is settled, you will not be able to make further claims against your employer for this same injury, so you should make sure the end result is the best you can do. 5. Once the curtain opens on staging a worker’s compensation claim, the focus immediately turns to how much money will wind up being paid on your behalf, and how much of the money that is due to you for your injuries on paper, winds up settling into someone else’s pockets. Do not expect a quick and simple end to your worker’s compensation claim; it will likely be a protracted process that will result in a “standard” amount of your settlement being paid to your lawyer, agreed payments for care to your doctors, unsettled bills the insurance company has weaseled out of paying becoming your responsibility to settle, and whatever is left, coming to you. A good metaphor for the entire process is thinking about a group of jackals tearing away at a carcass until nothing is left. 6. For some reason, a worker’s compensation claim also carries a stigma with employers that can become immediately apparent to an injured employee. Though few companies will have the courage to admit it, when a person files a worker’s compensation claim, many employers mount a campaign to eliminate that employee from their work force. Some will use illegal methods, while others cover their tracks with legal but unethical treatment. As the injured employee, you can pretty well be sure your days at your job are numbered when you step forward with your worker’s compensation claim, even though such treatment is completely unwarranted for the level of your service and performance. This information is mentioned to help you understand the hidden consequences and costs of using worker’s compensation. If you decide to pursue this direction, you should be sure the harm to you is serious enough to warrant enduring the process which will lead to a settlement. You might want to consider using the potential degree of permanent disability your work related injuries have caused you before you choose your avenue. Sadly, the protection of people and businesses has often reached a dividing line that is not so narrow or certain when it comes to fairness. The current system of worker’s compensation insurance is somewhat like Solomon’s suggestion to settle the dispute over who was the rightful mother of a child; rip the baby in half, and give each party a useless piece of what they wanted. Moving Rental Tips To Make Your Move Easier

By Lee Dobbins Moving out is not an easy thing to do and hiring the right moving rental truck or company can help ease the stress. Transferring from one house to another can surely be a stressful event. It is difficult because moving to a different place means adjusting to a different condition. Close friends and relatives are miles away. The neighborhood is not familiar. The new place also needs a lot of setting up. The best thing to do in situations like this is to make it easier by making the right decisions on the details of moving out. One aspect you must necessarily focus on is determining what things you should be bringing with you. There will surely be a lot of things in your old house that will be brought in to your new place. For one, it is relatively cheaper to move in with your old furniture and appliances rather than purchase brand new ones. There are items in the household that are considered irreplaceable, like items that have sentimental value. This includes photographs, plaques, trophies and even documents and certificates. Thus, it is really prudent and practical to bring along these important elements as you move out of your old house. The next thing to do is to find the right deal in moving out these things. Renting a moving vehicle or a portable on demand moving crate can be your best and easiest option to make sure your stuff gets moved to the new place the way you want them to. If you choose to rent a moving vehicle, you can rent it the day of the move or the day before. If you are able to rent it the day before, then you will have that whole day and evening to fill it up and then the next day to unload it at the new house. This way you can take your time and make sure your stuff gets moved carefully and not tossed around because you are in a hurry. If you really want a lot of time to make sure you can arrange your furniture and household goods in your moving vehicle, then you might consider an on demand storage unit. These units get delivered to your driveway and you have as long as you need to fill it up. Then, when it is full, you call the company and they will come and pick the container up and deliver it to storage or to your new home. No matter which moving rental option you choose, you will make things a lot easier on yourself if you weed out all the stuff that you havent used in a long time and donate it or throw it out. Start packing the items you want to keep but dont use everyday away well before the moving day. This way you can do it gradually and it wont be an overwhelming task. A Marketing Shortcut – Or Putting The Cart Before The Horse

By Siriol Jameson Marketing is magic. Now, the magic in marketing is to get it all done before you even have a product. That was the advice I got when I first started out in business. The person who told it to me was an old friend of my family. He was a magician by profession and he was also a multimillionaire marketer. He created more than a dozen businesses, built them up into money-makers and sold them. Along with all his magic tricks, he had one shortcut up his sleeve that, he maintained, helped him more than anything. Using this shortcut, he was able to launch his product faster than anyone else. Here is the shortcut: Write your sales letter before you find your product. To me, this sounded like putting the cart before the horse. But he assured me that it made life much simpler. Once he showed me how well it worked, I never looked back. It saves me a lot of time and wasted effort. Here are the 3 steps the magician used: 1) Decide who is going to buy your product. This helps you determine the area in which to specialize. For instance, owners of small businesses, cosmetic surgeons and golfers are three highly motivated groups. My magician friend marketed to two of them. He found them excellent customers who bought from him again and again. In another one of my friends businesses, he decided to market to parents of young children. He said they were open minded and often gave him new product ideas. His advice to me was to get to know some of your prospective buyers and spend time with them. Often, they will tell you what your next product is. 2) Once you choose your buyers, make a list of their wishes. In working with parents of young children, my friend said that some of their wishes included more free time, ways to save money and personalized products. My friend created a product that answered two of those wishes and he was able to make m0ney for himself as well. 3) Determine the value of your product. It should be of higher value than the price the customer pays for it. Compare your product to similar items on the market and show how yours is a better buy. Consider adding on another product to increase value. Value is almost always more important than price. Price comes into play only when it looks like the value of your product and those of your competitors looks the same. A buyer will then opt for the cheapest one. Good customer service, by the way, carries a very high value in the customers mind. Armed with information from the above three steps, my friend wrote a sales letter about an imaginary product he did not yet have. He even gave it a name. He wrote classified ads, articles, press releases and direct mail pieces. He then searched out a product or created one that fit his demands. He usually found more than one product. You can do the same thing. By the time you find a product, you will be ready to launch it almost immediately. And, your marketing will be ready and waiting. Siriol Jameson helps you make m0ney. Child Support Lookup — Looking Out for Your Child’s Best Interests

By Amit Mehta Child support lookup refers to the process of obtaining the records regarding child support cases. Although this is often preceded by the unfortunate separation or divorce of the parents, it is necessary in ensuring that the parties involved comply with the statutes of the law concerning this issue. Looking up child support cases ensures that the child is able to receive monetary support that guarantees that he or she grows up with a good education and a comfortable standard of living. The process is also important so that the care and upbringing of the child is not compromised simply because of the separation of the parents. Aside from legal separations, child support lookup also applies to those children with unwed parents, who are of course also required to extend assistance for the growth and well-being of their child. Child support requires that financial assistance for the child is automatically deducted from monthly paychecks of one of the parents (usually the one with whom the child is not staying with). In the instance that child support is withheld for one reason or the other, there are measures that can be undertaken, undertaken such as seizing ones property to ensure compliance. Researching Child Support Cases Child support lookup can be conducted by anyone willing to know about child support cases similar to their own. Of course, it can also be conducted for research purposes by people studying to get into or are already into family court cases. Although there are guidelines that the family court imposes on the amount of child support that is required, any child support lookup will reveal that there are still differences in the amounts since these are still reliant on other factors such as the income of the parents and the special needs of the children, if any. If you are planning to file a case dispute, gather all required information beforehand so that you can lay down all the facts and determine an appropriate course of action. If you already have a pending case, you can sometimes lookup the status of your child support case online. Online child support lookup records also help you in determining the average amount that children receive in a state so that you can decide if the amount you are requesting for, receiving or contesting is justifiable. There are still some restrictions regarding online child support lookup services in some states because this information, particularly financial data, is considered highly confidential. You will need to supply these online records providers with your name and a case number before the files are released to you. Want to Know the Top Sites to Lookup Child Support Records? The World’s Biggest Jerk

By Jeffrey Hauser Ive just watched another episode of Dr. Phil where another insensitive clod was cheating on his wife while she was caring for his three kids. He explained how he was feeling neglected and the sex wasnt the same anymore either. Really? What was she thinking putting the baby before him? Couldnt the little sucker wait for her to satisfy her husbands primal needs first, instead on crying to have his diaper changed or be fed? How insensitive of the newborn. Its not just on Dr. Phil. Cheating men are everywhere with all kinds of similar reasons for committing adultery. A few that I can remember are: (a) My wife doesnt look like the hottie she was ten years ago But you do? (b) I need change of scenery Then go on a vacation (c) We dont have enough sex It takes two to tango. (d) She spends too much time with the kids And your responsibility is what again? (e) Shes gained weight I suppose youre the same trim stud as you always were? (f) We never talk anymore Is your mouth sewn shut too? (g) It just happened when we got a new secretary And the new mailmans off limits? (h) We met in a bar and I was drunk When liquors involved, its always acceptable. (i) I dont have an excuse: it just happened Finally, an honest man. Remember why you married in the first place. Wasnt there something about commitment and responsibility? I realize that many woman cheat on their husbands and it works both ways. But this is about men. Ive seen these great looking women with these loser macho men that think theyre Gods gift to other ladies and somehow deserve better. Well, I have a clue for them: they arent and dont. Be thankful for what you have and make it work. Most of these guys dont realize how lucky they are and how many other guys lust after their wives. But, instead, they go trawling around after anything in a skirt, thinking that other woman cant wait to be hit on for a quicky. These shallow men make us all look bad. There are either really stupid when it comes to women or totally misguided. They dont understand the consequences of their actions and figure the whining bitch will always take them back when they come limping home after a failed affair. After all, who else would want the old, fat, kid-rearing, ex-hottie, that doesnt talk much, always looks about the same, and doesnt even give BJs anymore? I wonder why not? Look what our man did to deserve her affections before the affair. If all of this is lost on the men reading this article, I have a final word of advice. Its rarely, if ever, worth a few minutes of sexual pleasure with a stranger when your wife is more than willing to satisfy you. That is, if you are willing to do a minimal amount of loving and caring for her. But if thats too much to ask, then go right on being the worlds biggest jerk. Ephedra

By Todd Massey According to one information source over 100,000 people search for ephedra and ephedra products each and every month and that is only at just one of the major search websites. That is a lot of public interest and desire in an herb that the government claims is harmful when used as a weight loss agent. It seems to me that if ephedra were really so dangerous would that many common citizens continue to try and buy ephedra? That many people searching to purchase a weight loss herb also speaks volumes about how effective ephedra was for them at helping to shed pounds of fat. No other single herb seems to have had so much popularity and success in this arena. At this moment the FDA has declared ephedra products illegal, but they have yet to actually start cracking down on the websites where it is sold and the factories or warehouses where it is being made and stored. It is just a matter of time before the FDA does move in and put a stop to this. Although many sites are letting their stock simply sell out there are a few places still trying to rake in the cash with over-priced products and potentially fake ephedra products. Want to Buy Ephedra? The FDA left a loophole open if you know what to look for. Because of the hypocrisy of the FDA there is a way for you to always have the “power of ephedra” despite the fact that soon you will no longer be able to buy ephedra. Dont take chances or waste your money with fake or overpriced ephedra diet pills. The Black Market Report on Ephedrine was written by Todd Massey and has helped thousands of people break free from the ephedra ban. If you want to buy ephedra then that is the book you need. Canadians Need Cash Too! – A Cash Advance Primer

By [http://ezinearticles.com/?expert=Christopher_Young]Christopher Young Just like any other hard-working person, Canadians, too, need a cash advance from time to time. Before getting a cash advance, Canadian borrowers should obtain as much information as possible about the cash advance process. Payday loans may be lifesavers, but be sure you know all the facts before signing on the dotted line. Canadian cash advances are similar to those offered in the United States, however most American cash advance companies do not allow Canadian residents to participate. As a result, cash advance companies specific to Canadians were created to accommodate needs of the Canadian borrower in need of a cash advance. These companies are similar to those in the USA, but are not offered in all Canadian provinces. The loan process is actually quite simple. If you are a Canadian and you need extra cash right away, you can apply. Keep in mind, however, that these loans need to be paid off on your next payday. The loan amount usually depends on your income. Typically, a Canadian cash advance will fetch you anywhere from two-hundred to six-hundred dollars per pay period. Canadian cash advance interest rates average around twenty-five percent. If you are not able to pay off your cash advance by your next payday, you can get another cash advance and roll over the balance. The downside to this method is that the interest accumulates quickly. Twenty-five percent can easily turn into fifty percent in a relatively short period. When applying for a Canadian cash advance there are some basic criteria which must be met. First, you must be a resident of Canada. Second, you must have an active bank account because the only access to these cash advances is by direct deposit into a working bank account. Most companies require you to have five to seven transactions from that account already. Another requirement is that you must have a working phone. These companies rarely do credit checks, so a working telephone number is one of the few verifications of identity they conduct while at the same time ensuring their ability to contact you if need be. At the time of application it is usually required that you bring a pay stub. This gives cash advance companies an idea of the amount of money you make and likewise determines your loan amount. For example, the company cannot loan six hundred dollars to you if you make only three hundred dollars per week because, obviously, it would be impossible for you to pay them back in full on your next payday. Canadian cash advances, like American cash advances can be done within minutes. Some companies advertise loaning money to you in thirty minutes while others guarantee loans within twenty-four hours. Either way, it is much easier to go to your local cash advance company than to go to the bank for a small loan. The lack of credit checks, a simple application process, and speedy results make Canadian cash advances an attractive option for anyone needing quick cash with minimal effort. However, keep in mind that cash advances should only be used as a last resort and never as a routine way of making ends meet. Copyright 2005 by Christopher Young, Internet Financial Consultant. Franchise Agreements and Refusal to Renew

By Lance Winslow When the franchisor signs a franchise agreement with a franchisee it is very much like the marriage only it has a specific infinite time period called a term. Upon the end of the franchise agreement period a franchisor and a franchisee may agree to continue their marriage and renew the franchise agreement or one or more parties may decide to go their separate ways. A franchisor may have good reason for not wishing to renew the franchise and franchise law predicts that without a good reason failure to renew could in fact create litigation. However, if a franchisor states all possible reasons in advance that they were may not renew the franchise agreement with a franchisee in the initial franchise agreement, then the chances of litigation are lessened. Below is a copy of a clause that I used in both our master franchise agreements, as well as our individual franchisee agreements, which stated that conditions in which our company may choose not to renew; 1.3.3 Refusal to Renew Notwithstanding the foregoing provisions, Franchisor will not be obligated to renew Franchisees rights to operate as a Franchisee of Franchisor if Franchisee has failed to satisfactorily comply with Franchisees duties, obligations and covenants during the preceding term or is then in default of any provisions of this Agreement. The determination of satisfactory compliance will be within the exclusive discretion of Franchisor in good faith. If Franchisor refuses to renew, Franchisee must continue to perform under this Franchise Agreement until its expiration. Continuation. If Franchisee is in the process of transferring the Franchised Business at the time of expiration Franchisee may be allowed to continue to operate the Franchise with Franchisors express consent, following the expiration or termination of this Agreement. The continuation will be a month-to-month extension of this Franchise Agreement. Otherwise, all provisions of this Agreement will apply while operations continue. ——– ——— ——— Since this is an area of law in the world a franchising, which has been known to create a controversy so, any and all franchisors are well advised to speak to a knowledgeable and an experienced franchise attorney on the subject matter. I hope you’ll take my advice and seek legal and also consider all this in 2006. “Lance Winslow” – Online Think Tank forum board. Jar Lid and Jar Candle Decoration

By Michelle Gauthier Supplies Needed: Most items can be found around the house or in a craft store. Jar Candle with lid with removable plastic bottom Craft Glue Paint Scissors Decorating Candle Jars and Lids is a fun and easy project for all ages. You can use many different craft items to embellish your jar and lid. If you are really creative, you could even make a snow globe out of the lid. But we are going to go over a few inexpensive ideas to turn your Jar into an attractive looking and still functional decoration. Most jar lids come with a plastic under cap, which can be taken off by a screw driver. In this space you can add many different things, from dried flowers to an elaborate scene. One of my favorite things to do is to add fake flowers and greens to my lid, typically using the same color flower as my jar wax. Everything can be placed at the top of the lid and adding green leaves to keep it secure. Sand, Rocks or Marble pieces can add a different look to the lid. One great idea is to use different layers of colored sand. Just make sure you fill it to the top, because the under cap will have a little bit of space. You’ll get the same look as those colored bottles that you can buy at fairs. For rocks, try using some Aquarium rocks, as they come in multiple colors. You can add a more personal touch by adding a picture or personal message in the lid. Just cut the picture to fit the lid and put some kind of background behind it. One idea is to use a nice piece of colored felt or velvet fabric. By adding enough fabric, you can be assured the picture will stay where it is. I do not recommend using glue on the top of the lid, as it will be visible. You can also just use a pattern fabric to place inside the lid. A great idea would to use a pattern that is in your room, maybe a leftover piece of wallpaper. Then you have a matching Jar to your room. Don’t laugh, but I cut off a small piece of fabric from the underside of my chair to use in a lid, so that it matched my furniture. The jar itself can be decorated in so many ways, its impossible to list them all here. So I’ll show a design and some ideas that I thought would be great to give as a gift to someone. One of my favorite designs is to use my old Christmas cards or a specific holiday card as a design on my jar. Cut the card it to fit the jar, and then glue it to the jar using crafters glue or glue dots. This is a great idea for a gift around Valentines or Christmas time. You could even use the inside of the card with the message. And to top it off, adding a picture of yourself on the other side of the jar, will add a nice personal touch. There are many things you can do to decorate your jar. Using some of the ideas above, like the pattern in the lid, you can also use it on the jar. Some other ideas are, painting a scene or message on the jar, gluing ribbon strips vertically to add stripes, gluing flowers to the base, adding your own custom label and something as simple as red lipstick kisses all over the jar. Your creativity holds no bounds. So have fun and try anything, I bet it will come out fabulous. Many Horse Gifts to Consider

By Anne Clarke If you happen to know a horse lover or horse enthusiast, there are great horse gifts out there just for them. Whether it is a horse gift for Christmas, or a birthday, or just a little something for your self. The gift you choose will depend on the needs, accommodations, and personal taste of the receiver. Sometimes horse equipment is the best kind of horse gift possible. For example: equipment like new saddles and bits etc. will make great horse gifts when they are needed. Another practical horse gift for any horse enthusiast who is not too fond of little horse trinkets would be a book about horses. A book about horses, whether it is fiction or non-fiction would be my favorite kind of horse gift. I love to read and learn more about horses, and so will many other horse enthusiasts out there. Other great horse gifts for the horse enthusiast in your life include weathervanes, jewelry and t-shirts. My mother grew up on a ranch in Montana. She has had much experience with horses, mostly riding. But she always loved to watch the trainers working with the horses. Therefore she learned a little about how a wild horse is broken in and taught to live on a ranch like hers, or how a new colt is trained. My mother watched the births of many colts while growing up, and even assisted in a birth once. We still visit the ranch from time to time, but it never feels like enough. I think that having little mementos of horses helps her miss the ranch less. Or, maybe it makes her miss it more. Either way, when she looks at her horse statuettes or jewelry, a little smile plays upon her lips. Even though she has left her home in Montana and moved on in the world, my mothers passion for horses has not diminished. She went to school for business and opened her own store, where she sells mostly trinkets and antiques. You can tell from the appearance of the store that the owner is a horse enthusiast, because so many items she sells have a horse theme, like the horse gifts we give her do. She wears horse t-shirts all the time, many of which were gifts. And whenever she opens a horse giftupon seeing it she smiles more brightly than at any other time. The only other time I see that same smile on her face is when she is riding. She still has a horse of her own in Montanawhom she visits as often as she can. We have also dedicated time as a family to go riding every once and awhile here in upstate New York, where I grew up.
